This e-Capsule examines the grounds for non-execution of a European Arrest Warrant (EAW) when the requested person has been tried in absentia. This is crucial to ensure that the execution of EAWs is carried out in full compliance with European Union (EU) law, particularly the provisions set out in Council Framework Decision 2009/299/JHA.  It equips legal professionals with the knowledge to identify when an EAW may be lawfully denied on the basis of an in absentia trial.
