The Proportionality Test Directive aims to ensure that new regulations affecting access to (or the pursuit of) regulated professions in the EU Member States are justified and proportionate, preventing unnecessary restrictions.
It requires national authorities to conduct a thorough assessment of the proportionality of any such new or amended rules before their adoption.
This Directive lays down rules on a common framework for conducting proportionality assessments before introducing new, or amending existing, legislative, regulatory or administrative provisions restricting access to, or the pursuit of, regulated professions, with a view to ensuring the proper functioning of the internal market.
Target audience
National authorities at any level involved in the introduction of new, or amended existing, legislative, regulatory or administrative provisions restricting access to, or the pursuit of, regulated professions falling within the scope of the Proportionality Test Directive, as well as other national actors that play a role in the assessment and/or notification(reporting) of these rules.
