This e-Capsule examines Article 47 of the Charter of Fundamental Rights of the European Union (EU) (the Charter), which safeguards the right to effective judicial protection. It highlights the key protections guaranteed by this right and explores its interaction with other rights enshrined in the Charter. The module offers a thorough understanding of both the right to an effective remedy and the right to a fair trial.

By the end of this e-Capsule you should be able to:  

  • Understand how the right to an effective remedy and the right to a fair trial encompass related rights, such as fair hearing and legal aid. 
  • Understand the circumstances in which these rights may be restricted, in accordance with the Charter, illustrated through case studies.  
  • Understand the interrelation of Article 47 of the Charter with all “rights and freedoms guaranteed by the law of the Union”, through practical case studies.
