This e-Capsule focuses on Council Regulation (EC) 4/2009 (Maintenance Regulation), which provides a common set of uniform rules for Member States for cross-border situations involving maintenance obligations.  It uses concrete scenarios and examples to identify the criteria of maintenance obligations, determine jurisdiction, and identify the role of the central authority.

Target audience

This e-Capsule is designed to provide justice professionals, particularly judges, prosecutors, court staff, lawyers and bailiffs, with a comprehensive understanding of the management of cross-border maintenance cases.

Learning objectives

By the end of this e-Capsule you should be able to:
  • Apply the procedure on the recognition and enforcement of decisions on maintenance obligations. 
  • Understand the rules on the new maintenance obligations that replaced older European Union (EU) instruments. 
  • Understand, use and apply the rules on maintenance obligations and collaborate effectively with the central and competent authorities of the relevant Member States.
